SCENTSAN E-COMMERCE WEBSITE AND MOBILE APPLICATION MEMBERSHIP AGREEMENT

MEMBERSHIP AGREEMENT

1. Parties

a) Scentsan Elektronik ve Teknoloji A.Ş. (hereinafter referred to as Scentsan) located at Fevzi Çakmak Mahallesi, Demir Caddesi, No:15/D Karatay/Konya, which operates the scentsan.com website and mobile applications.

b) Internet user who is a member of the scentsan.com website and mobile application ("Member").

2. Subject of the Agreement

This agreement covers the determination of the terms of the member's use of the scentsan.com website and mobile application owned by Scentsan.

3. Rights and Obligations of the Parties

3.1. The member accepts and undertakes that the personal and other information provided while becoming a member of the scentsan.com website and mobile application is correct within the framework of the law, and that Scentsan will compensate all damages it may incur due to the inaccuracy of this information.

3.2. The member cannot give the password given to it by Scentsan to other people, the right to use this password belongs only to it. For this reason, Scentsan reserves all responsibilities that may arise and all claims and demands that may be made against Scentsan by third parties or authorized authorities, and all kinds of compensation and other claims arising from the unauthorized use in question.

3.3. The member accepts and undertakes to comply with the provisions of the legal legislation and not to violate them while using Scentsan's website and mobile application. Otherwise, all legal and criminal liabilities that may arise belong exclusively to the member.

3.4. The member cannot use Scentsan's website and mobile application in a way that disrupts public order, is against general morality, disturbs or harasses others, or in a way that infringes on the intellectual and copyrights of others. The member cannot engage in activities that make it difficult or prevent other users from benefiting from the services (spam, virus, trojan horse, etc.).

3.5. The views and thoughts expressed by members on the Scentsan website and mobile application are entirely the members' own personal opinions. These views cannot be associated with Scentsan in any way. Scentsan is not responsible for these views expressed by members.

3.6. Scentsan is not responsible for unauthorized reading of member data and damages that may occur to member software and data. The member agrees in advance not to claim compensation for any damages that may arise from the use of Scentsan's website and mobile application.

3.7. The member agrees not to access or use the software and data of other internet users without permission. Otherwise, the legal and criminal liabilities arising from this belong to the member.

3.8. The member who violates one or more of the articles listed in this agreement is personally responsible for the legal and penal consequences that will arise from these violations. The member agrees to hold Scentsan harmless from the consequences of these violations. In addition, the member accepts that Scentsan reserves the right to claim compensation for these violations.

3.9. Scentsan has the right to delete the member's membership and files, documents and information when necessary. The member accepts this disposition in advance and cannot make any demands from Scentsan in this case.

3.10. The software and design of the scentsan.com website and mobile application are the property of Scentsan, and copyright and other intellectual property rights are protected by the relevant laws. The member cannot use, acquire or change the content of the site and application without permission.

3.11. Scentsan may collect certain information such as the name of the internet service provider used to access the website and mobile application, IP address, date and time of access to the website for the development of the website and mobile application or within the framework of legal regulations.

3.12. Scentsan may disclose the member's personal information when requested as a legal obligation or when it believes in good faith that it is necessary to (a) comply with legal requirements, (b) protect the rights and property of Scentsan and scentsan.com website and mobile application.

3.13. Measures have been taken to clean the Scentsan website and mobile application from malicious software. However, ensuring ultimate security is possible by the member installing their own antivirus protection system and taking the necessary measures. The member accepts that they are responsible for any errors that may occur in their own software and operating systems.

3.14. Scentsan has the right to change the content of the website and mobile application at any time, terminate the services or delete user information.

3.15. Scentsan may change the terms of the membership agreement at any time without prior notice. The changes will be valid for all members as of the publication date.

3.16. The parties agree that all computer records belonging to Scentsan will be taken as exclusive evidence.

3.17. Scentsan has the authority to send information e-mails to the member's e-mail address and information SMS messages to the member's mobile phone. The member accepts to receive these notifications by approving the membership agreement.

4. Termination of the Agreement

This agreement will remain in force until the member cancels his/her membership or until his/her membership is canceled by Scentsan. Scentsan has the right to unilaterally terminate the membership of the member who violates any provision of the membership agreement.

5. Resolution of Disputes

Konya Courts and Enforcement Offices will have jurisdiction over disputes arising from this agreement. Both parties accept the laws of the Republic of Turkey in resolving disputes arising from this agreement.

6. Enforcement

The member's registration as a member means that he/she has read and accepted all the articles in the membership agreement. This agreement has entered into force mutually at the moment the member becomes a member.
